Terms and Conditions
Please read these terms and conditions of use (“Terms and Conditions”) carefully as it is a legally binding agreement between you and Danone Dumex (Malaysia) Sdn. Bhd. (“Danone Dumex”), including each member of the group of companies of which Danone Dumex is the parent, subsidiary or affiliate company. If you proceed to use this Site, you are agreeing to all of the Terms and Conditions, which includes our House Rules for our Forums and Danone Dumex Friends that are available on this Site.
Acceptance of the Terms and Conditions
1. This Site is produced by Danone Dumex for your information, education and communication. Please feel free to browse this Site.
2. This Site and its contents are designed to comply with Malaysian laws and regulations and are intended for use by Malaysian residents only. Danone Dumex makes no representation that any information contained in this Site is relevant or compliant with the laws of other jurisdictions.
3. This Site offers you the option of viewing information about Danone Dumex’s maternal and growing up milks. If you choose to view this information, you are accepting that Danone Dumex is supplying this information at your individual request for information and educational purposes only.
Account registration, maintenance and termination
4. Once you have completed the registration process, you will have specified a username (email address) and a password and become a member of this Site (“Member”). You must ensure that you keep your username and password in a safe and secure place and that you do not disclose them to anyone. You will be fully responsible for all activities which occur under your username and password. It is your responsibility to immediately notify us of any unauthorized use of your username and password or any other breach of security as soon as you become aware of it. We reserve the right to require Members to amend their username and passwords if necessary for security reasons.
5. You agree that any registration information you give to Danone Dumex will always be accurate, correct and up to date. All accounts must be registered with a valid personal email address that you access regularly so that moderation emails can be sent to you. Accounts registered with someone else’s email address, or with temporary email addresses may be closed without notice. We may require Members to re-validate their account if we believe they have been using an invalid email address.
6. We reserve the right to disable and/or terminate accounts if any Member is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple Danone Dumex accounts, or if a non-Malaysia-based Member pretends to be a Malaysia-based Member, or disrupts any of our services in any way, or otherwise carries out any unlawful act contrary to the Terms and Conditions. You acknowledge and agree that if Danone Dumex disables and/or terminates access to your account, you may be prevented from using or accessing the services provided on this Site, your account details or any files or other content which is contained in your account.
Disclaimer and limitation of liability
7. Intellectual property
9. You understand that this Site contains information, text, data, images, graphics, button icons, unregistered trade marks, illustrations, photographs, audio clips, music, sounds, pictures, videos, software or other forms and formats now known or later invented (“Content”). The copyright in some of this Content belongs to Danone Dumex, its subsidiaries, affiliates and/or partners (“Our Content”). Users of this Site may download Our Content for their own personal, non-commercial use, provided all copyright and other proprietary notices are kept intact. The copying, redistribution, re-posting, publication, adaptation or alteration of any of Our Content on this Site for any public or commercial purposes is prohibited without the prior written permission of Danone Dumex.

Notwithstanding the above, when you transmit or post any Content on this Site (for example, on our forums), Danone Dumex agrees that you own all legal right, title and interest in and to the same (“Your Content”). If you wish to bring to our attention any unlawful activity associated with any Content posted by a user or Member of this Site or otherwise available on this Site and you would like to file a complaint with us, please use the ‘report abuse’ link found on any page which contains content supplied by users or Members of this Site.

14. Personal information voluntarily submitted to Danone Dumex via this Site, such as interactive registration may be used by Danone Dumex. It may also be used internally to assess the function of our Site and the needs of our customers. Danone Dumex advises that you never reveal any personal information about yourself or anyone else (for example: telephone number, postal address, home address or email address, or any other details that would allow you to be personally identified), in any Danone Dumex community. Danone Dumex is not responsible for any subsequent actions or events resulting from such personal information being voluntarily revealed by you.

Danone Dumex is not responsible for and may not have control over the content of any Third Party Sites, which are provided by companies or persons other than Danone Dumex. General terms and conditions
18. Danone Dumex reserves the right to alter or delete material from this Site at any time.
19. Danone Dumex may, at any time, revise the Terms and Conditions by updating this posting. You are bound by any such revisions and should, therefore, periodically visit this page to review the then current Terms and Conditions.
20. You agree to indemnify, defend, and hold harmless Danone Dumex (including its affiliates and subsidiaries) and its officers, employees, agents, business partners, licensors, and licensees from any damages, liabilities, costs, and expenses (including reasonable legal fees) on account of any claim, suit, action, demand, or proceeding made or brought against any such party, or on account of the investigation, defence, or settlement thereof, arising in connection with your use of this Site, including Your Content.

You agree that if Danone Dumex does not exercise or enforce any legal right or remedy which is contained in the Terms and Conditions (or which Danone Dumex has the benefit of under any applicable law), this will not be taken to be a formal waiver of Danone Dumex’s rights and that those rights or remedies will still be available to Danone Dumex.
22. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of the Terms and Conditions is invalid, then that provision will be removed without affecting the rest of the Terms and Conditions and the remaining provisions therein shall continue to be valid and enforceable.
House Rules
1. The House Rules form part of the Terms and Conditions and must be accepted before you proceed to use this Site.
2. We do not control, screen or edit any Content provided by Members that is posted to or from or made available on our Site, including Your Content (as defined above). However, we reserve the right, but not the obligation, in our sole discretion and for any reason, to pre-screen, edit, and refuse to accept or remove or move any Content which has been transmitted to, from or via, or posted on, this Site by a Member. We will not be liable for doing this.
3. In order that Danone Dumex can use your contribution, you confirm that your contribution is your own original work, is not libelous or defamatory, does not infringe any rights of third parties and is not otherwise unlawful; that you have the right to give Danone Dumex permission to use it, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16 years of age.

You are not permitted to use this Site (or any of our services) for any reason or purpose which is unlawful, libelous, defamatory, harassing, harmful, abusive, and/or invasive of another’s privacy or objectionable and, in particular, you are not permitted to transmit anything which, in our opinion, harms our business or offends other Members of this Site. In accordance with the Terms and Conditions, you agree that you are solely responsible for (and that Danone Dumex has no responsibility to you or to any third party) for Your Content and for any breach or infringement of other’s rights caused by Your Content, including any loss or damage arising there from.
A. Forums
1. We have established these Forums' rules so that everyone can get the most out of our Site. These rules protect all Members of this Site by making sure that any and all communications are safe and fun for everyone.
• Please keep all contributions civil and tasteful.
• No disruptive, offensive and/or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
• No unlawful or objectionable content: unlawful, harassing, defamatory, libelous, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
• If you use multiple logins for the purpose of disrupting the community or annoying other Members you may have action taken against your accounts.
• Be patient: Members of all ages and abilities may be taking part.
• When voicing an opinion please be sensitive to the circumstances of other people who may be online.
• We welcome personal recommendations for products, books, website addresses or other materials that you have found useful in your experience. However, we will take action against submissions that we judge to be advertising, or promoting materials or websites we deem to be inappropriate (vulgar, offensive etc). Danone Dumex does not accept responsibility for the content of such recommendations.
• Commercial messages and messages from businesses or organisations are not permitted. Our Forums are for use by parents and parents-to-be, they are not to be used as a medium for marketing or selling to Members.
• No impersonation.
• No inappropriate user names (e.g. vulgar, offensive etc).
• The Forum moderator may from time to time post messages, intervene or edit or delete messages.
• We welcome feedback, both positive and negative, but please make sure your comments are in line with the above rules. Repeatedly posting personal or offensive comments about members of the public or companies may be considered harassment. We reserve the right to take action against those responsible.
• To help make sure you get the right information, our own team of advisors will occasionally join in on a Forum if they are needed.

Safety tips
• Be careful when using a Forum. Remember, people online may not be who they say they are. Anyone with access to the internet can obtain access to our Site.
• Think twice when giving out any personal information. This includes your name, address, telephone number, mobile number, private email address, photograph etc.
• Be cautious when meeting someone you have only been in touch with online. If you would like to meet them, do so in a public place in the daytime. For your own safety tell someone where you will be going and when, or take someone along with you, at least for your first meeting.
B. Danone Dumex Friends
1. In joining Danone Dumex Friends, you agree to share the following information with other parents and parents-to-be who might want to contact you: your username, your supplied profile, your baby's birth month, and your location proximity from them (within 2 miles). Otherwise, you may not supply any information so as not to be available and you may not sign up to Danone Dumex Friends.
2. We have established these Danone Dumex Friends’ rules so that everyone can get the most out of our Site. These rules protect all Members of this Site by making sure any and all communications are safe and fun for everyone.

Notification and Enforcement
1. If you fail to abide by the Terms and Conditions (including the House Rules), you will be sent an e-mail which informs you why your contribution has failed or been edited. This mail will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.
2. This action may include your relevant account or accounts being placed into pre-moderation or a temporary or permanent suspension of your ability to participate in any or all of the services on this Site.
3. If you post or send offensive and/or inappropriate Content anywhere on this Site or otherwise engage in any disruptive behaviour, and we consider such behaviour to be serious and/or repetitive, we may use whatever information that is available to us about you to stop any further such infringements or unlawful conduct. This may include informing relevant third parties such as your employer, educational establishment, email service provider or other authorities about the said infringements or unlawful conduct. We reserve the right to delete any contribution, or take action against any account, at any time, for any reason.
